1. GENERAL

These Terms and Conditions (“Terms”) govern the use of the website gts-concept.ch and the booking and coordination services offered by:

Global Trust Solutions AG

operating under the brand

GTS Executive Chauffeur Services

c/o Blauschild GmbH

Bahnhofstrasse 4

9100 Herisau AR

Switzerland

GTS Executive Chauffeur Services (“GTS”, “we”, “us” or “our”) operates a booking and coordination platform connecting clients with independent, professional and appropriately licensed transportation partners in Switzerland and other European countries.

Unless expressly stated otherwise, GTS does not itself perform the transportation service. Transportation services are performed by independent transportation partners and their assigned chauffeurs.

By submitting and confirming a booking through our website or other accepted booking channels, you acknowledge and agree to these Terms.

2. ROLE OF GTS

GTS facilitates the booking, coordination and administration of chauffeur-driven transportation services.

Depending on the booking, GTS may:

  • receive and process booking requests;

  • provide quotations;

  • identify an appropriate transportation partner;

  • coordinate the requested journey;

  • communicate booking information;

  • collect or facilitate payment;

  • provide customer support; and

  • transmit information necessary for the performance of the journey to the selected transportation partner.

The actual transportation service is performed by the transportation partner assigned to the booking.

Transportation partners operate as independent businesses and are responsible for maintaining the licences, permits, insurance and professional requirements applicable to the transportation services they perform.

3. BOOKINGS AND CONTRACT FORMATION

Bookings may be requested through our website, email, telephone or other communication channels made available by GTS.

Submitting a booking request does not in itself guarantee vehicle availability or constitute final confirmation of the requested transportation service.

A booking becomes confirmed when the client receives a booking confirmation from GTS specifying the essential details of the service.

Clients must review the booking confirmation and notify GTS as soon as possible of any incorrect information.

GTS reserves the right to decline a booking request where no suitable transportation partner or vehicle is available.

For online bookings, the client will have the opportunity to review the relevant booking information before submitting the order.

4. CLIENT RESPONSIBILITY FOR BOOKING INFORMATION

The client is responsible for providing accurate and complete information, including where applicable:

  • passenger name;

  • telephone number;

  • email address;

  • pickup location;

  • destination;

  • pickup date and time;

  • flight or train information;

  • number of passengers;

  • luggage requirements;

  • child-seat requirements; and

  • other information relevant to the requested journey.

GTS and the transportation partner cannot be held responsible for consequences directly resulting from materially incorrect or incomplete information supplied by the client, subject to mandatory applicable law.

5. PRICES

The price applicable to a booking will be communicated to the client before the booking is confirmed.

Unless otherwise expressly indicated, the confirmed price covers the transportation service described in the booking confirmation.

The booking confirmation or quotation will specify, where relevant, whether the price includes:

  • applicable taxes;

  • tolls;

  • parking;

  • airport charges;

  • standard waiting time; and

  • other charges associated with the requested service.

Additional charges may apply where the client subsequently requests material changes to the confirmed service, including additional stops, significant route changes, additional waiting time or an extension of the journey.

Any foreseeable additional charges should, where reasonably possible, be communicated to the client.

6. PAYMENT

Depending on the booking, payment may be made using the payment methods offered by GTS, which may include:

  • credit or debit card;

  • bank transfer;

  • electronic payment service; or

  • invoice for approved corporate clients.

Payment or payment authorisation may be required before the transportation service is performed.

The applicable payment conditions will be communicated during the booking process or stated in the booking confirmation or invoice.

Payments may be processed by independent payment service providers.

7. CANCELLATIONS

Unless different cancellation conditions are expressly stated in the quotation or booking confirmation, the following standard policy applies:

  • More than 24 hours before the scheduled pickup:

    Cancellation free of charge and, where payment has already been made, refund of the amount paid for the cancelled service.

  • Less than 24 hours before the scheduled pickup:

    Up to 100% of the confirmed booking price may be charged.

  • No-show:

    Up to 100% of the confirmed booking price may be charged.

A passenger may be considered a no-show where the passenger cannot be located or contacted after the applicable complimentary waiting period and reasonable attempts have been made to contact the passenger using the contact information supplied with the booking.

Special journeys, large vehicles, multi-day services, events or bookings requiring specific arrangements may be subject to different cancellation conditions. Any such conditions must be communicated before confirmation of the relevant booking.

8. BOOKING MODIFICATIONS

Requests to change a confirmed booking are subject to availability.

Changes may include:

  • pickup time;

  • pickup location;

  • destination;

  • passenger numbers;

  • vehicle category;

  • additional stops; or

  • other material changes to the journey.

Where a modification affects the cost of the transportation service, the client will be informed of the corresponding price adjustment where reasonably practicable.

9. AIRPORT PICKUPS AND FLIGHT DELAYS

Where a valid flight number has been provided, the transportation partner may monitor available flight information in order to coordinate the pickup.

Unless otherwise stated in the booking confirmation, airport pickups include up to 60 minutes of complimentary waiting time, calculated from the actual flight arrival time or other pickup reference specified in the confirmation.

The client should inform GTS as soon as reasonably possible of significant itinerary changes, missed connections or flight changes.

Flight monitoring does not constitute a guarantee that every operational change or airline update will be detected immediately.

10. NON-AIRPORT PICKUPS AND WAITING TIME

Unless otherwise stated in the booking confirmation, standard non-airport pickups include up to 15 minutes of complimentary waiting time from the confirmed pickup time.

Additional waiting time may result in additional charges.

Where possible, the client will be informed before significant additional waiting charges are incurred.

11. VEHICLES

Vehicle images displayed on the GTS website are illustrative of the vehicle categories that may be available through our transportation partner network.

Unless a specific vehicle model has been expressly guaranteed in writing, bookings relate to a vehicle category rather than a specific make, model, colour or registration number.

If the originally planned vehicle becomes unavailable due to mechanical problems, operational circumstances, safety considerations or another unforeseen event, GTS and/or the transportation partner may arrange a suitable replacement vehicle.

Where reasonably possible, the replacement will be of an equivalent or higher category.

12. CHAUFFEURS AND TRANSPORTATION PARTNERS

Transportation services booked through GTS are performed by independent transportation partners.

GTS seeks to work with professional transportation providers that meet the standards applicable to the services they perform.

Transportation partners remain responsible for their:

  • operating licences and authorisations;

  • chauffeurs;

  • vehicles;

  • insurance;

  • roadworthiness;

  • compliance with applicable transportation laws; and

  • actual performance of the transportation service.

GTS may replace an assigned transportation partner where reasonably necessary to ensure that a confirmed booking can be performed.

13. PASSENGER CONDUCT

Passengers must behave in a manner that does not endanger the chauffeur, other passengers, the vehicle or third parties.

Unless expressly permitted by the transportation partner, smoking and vaping are prohibited inside vehicles.

The possession or consumption of illegal substances is strictly prohibited.

The chauffeur may refuse to commence or continue a journey where a passenger behaves violently, abusively, unlawfully or in a manner presenting a genuine safety risk.

Such circumstances will be assessed reasonably and in accordance with applicable law.

14. DAMAGE AND EXCESSIVE CLEANING

The client may be responsible for reasonable costs resulting from damage to a vehicle caused intentionally or negligently by the client or passengers included in the booking.

Reasonable cleaning charges may also apply where extraordinary cleaning is required as a direct result of passenger conduct.

Any such claim should be supported by appropriate evidence and reflect the actual or reasonable cost of repair or cleaning.

15. LUGGAGE

The client is responsible for selecting a vehicle category suitable for the number of passengers and amount of luggage.

Clients should inform GTS in advance of unusually large luggage, sports equipment, wheelchairs or other items requiring special arrangements.

Transportation may be refused where luggage cannot be safely carried in the assigned vehicle.

16. CHILDREN AND CHILD SEATS

Where a child seat or other child restraint is required, the client must inform GTS during the booking process.

Availability must be confirmed in advance.

Applicable legal requirements concerning the transportation of children remain mandatory.

17. DELAYS AND FORCE MAJEURE

GTS and transportation partners will use reasonable efforts to provide services according to confirmed booking details.

However, delays or disruptions may occur because of circumstances outside reasonable control, including:

  • severe weather;

  • accidents;

  • extraordinary traffic conditions;

  • road closures;

  • police or governmental measures;

  • strikes;

  • natural disasters;

  • airport disruptions;

  • flight cancellations;

  • border restrictions; or

  • other comparable extraordinary events.

Nothing in these Terms excludes or restricts liability where such exclusion or restriction would be prohibited by applicable mandatory law.

18. LIABILITY

GTS is responsible for its own booking, coordination and administrative activities in accordance with applicable law.

The independent transportation partner performing the journey is responsible for the actual transportation service within the scope provided by applicable law.

Nothing in these Terms is intended to exclude or limit liability for wilful misconduct, gross negligence, personal injury, or any other liability that cannot lawfully be excluded or limited.

19. LOST PROPERTY

Passengers are responsible for their personal belongings.

If an item is believed to have been left in a vehicle, the client should contact GTS as soon as possible.

GTS will reasonably assist the client in contacting the relevant transportation partner but cannot guarantee recovery of lost property.

Reasonable delivery or shipping costs for returning recovered property may be charged to the client.

20. COMPLAINTS

Any complaint concerning a booking or transportation service should be submitted as soon as reasonably possible to:

booking@gts-concept.ch

The complaint should include the booking reference and sufficient information to allow the matter to be investigated.

GTS will, where appropriate, coordinate with the transportation partner concerned in order to investigate the complaint.

21. DATA PROTECTION

Personal data is processed in accordance with our Privacy Policy and applicable data protection law, including the Swiss Federal Act on Data Protection and, where applicable, the EU General Data Protection Regulation.

Information necessary to perform a booking may be transmitted to the transportation partner assigned to the journey.

Please consult our Privacy Policy for further information.

22. WEBSITE CONTENT AND INTELLECTUAL PROPERTY

Unless otherwise indicated, the content of the GTS website, including text, branding, graphics and original website materials, is owned by or lawfully used by Global Trust Solutions AG.

Unauthorised reproduction or commercial use is prohibited to the extent permitted by applicable law.

Third-party trademarks and vehicle manufacturer names remain the property of their respective owners.

23. GOVERNING LAW AND JURISDICTION

These Terms and contractual relationships with Global Trust Solutions AG are governed by Swiss law, subject to any mandatory provisions of law applicable to the client.

For business clients, to the extent legally permissible, the competent courts at the registered office of Global Trust Solutions AG shall have jurisdiction.

For consumers, the mandatory statutory rules concerning jurisdiction remain fully reserved. Nothing in these Terms deprives a consumer of a court or other protection available under mandatory applicable law.

24. CHANGES TO THESE TERMS

GTS may update these Terms from time to time.

The Terms applicable to a confirmed booking are generally those made available to and accepted by the client when the booking was concluded, unless a subsequent change is required by mandatory law or expressly agreed by the parties.

The latest version will be published on our website with its revision date.

25. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
